Chubbuck, ID–Local watchdog group Pocatello for Accountable Government Entities reported yesterday that a lawsuit has been filed against a group of Northgate developers.  Their social media post reads:

A lawsuit has been filed with a potential impact to some acreage within the Pocatello Development Authority’s (PDA) Northgate TIF District boundaries. The lawsuit does NOT name any governmental entities.

Case CV03-22-03493 was filed in Bannock County District Court on 10/21/2022 by Plaintiffs, James Hart and David Hart. The named defendants are:

Millennial Development Partners, LLC, a Utah Limited Liability Company;
Portneuf Development, LLC, an Idaho limited liability company;
Portneuf Builders, LLC, an Idaho limited liability company;
Pape, Ken; and Swaney, Arvil B.
It centers on a 2017 Purchase and Sales Agreement (PSA) between Millennial Development and the Harts.
In the 40-page complaint document, the plaintiffs (Harts) request a declaration from the court that includes (in part) that: “The sale of property between Millennial and the Harts is void, invalid, and unenforceable.”

*Please note this case has not yet been adjudicated and no determinations have been made as to the allegations.
