Yesterday, Pocatello for Accountable Government Entities (P.A.G.E.) posted information on their Facebook page regarding two lawsuits filed on February 4, one of which is in the U.S. District Court for the District of Idaho by the Rupp Family Trust against the City of Pocatello, Mayor Brian Blad, and others.  The lawsuit alleges fraud, conspiracy, etc.

The P.A.G.E. post reads, “On Friday, February 4, 2022, two court cases were filed against the City of Pocatello and other named defendants.  One in Federal Court and one in State Court.

Per the 97-page Federal court document P.A.G.E. obtained today as a public record, Case # 4:22-cv-00050-DCN – was filed in U.S. District Court for the District of Idaho on 02/04/22 by the Harold L. Rupp Sr. Trust, an Idaho Trust; and Veda J. Rupp Revocable Living Trust, an Idaho trust against the City of Pocatello, an Idaho municipality; Millennial Development Partners, LLC, a Utah limited liability company; Portneuf Development, LLC, an Idaho limited liability company; Portneuf Builders, LLC, an Idaho limited liability company; Brian Blad, in both his official and individual capacities; Ken Pape, individually; Arvil B. Swaney, individually; and John or Jane Does 1-10.

Attached are the 27 pages of the “Complaint for Declaratory and Monetary Judgment” for the Federal Court Case. The remaining pages are exhibits.

An additional Case (# CV03-22-00398) was filed in the District Court of the Sixth Judicial District of the State of Idaho, in and for the County of Bannock on 02/04/2022 by the Harold L. Rupp Sr. Trust, an Idaho trust; and Veda J. Rupp Revocable Living Trust, an Idaho trust against the City of Pocatello, an Idaho municipality; Millennial Development Partners, LLC, a Utah limited liability company; Portneuf Development, LLC, an Idaho limited liability company; Portneuf Builders, LLC, an Idaho limited liability company; Ken Pape, individually; Arvil B. Swaney, individually; and John or Jane Does 1-10.  We have not yet received the complaint filed in the Sixth Judicial District Court of Idaho for the County of Bannock.”
